Terms of Service

1. Acceptance of Terms

  • 1.1 By using Bluecall’s VoIP and UCaaS services (“Services”), you agree to be bound by these Terms of Service (“ToS”). If you do not agree to these terms, do not use the Services.
  • 1.2 Bluecall may modify this ToS at any time, with or without notice. Continued use of the Services after changes indicates acceptance of the new terms.

2. Use of Service

  • 2.1 The Services are provided for your business’s internal use and subject to all applicable local, state, federal, and international laws.
  • 2.2 You are responsible for all activity under your account and ensuring that your use of the Services complies with this ToS.

3. User Obligations

  • 3.1 You agree not to misuse the Services, including but not limited to: engaging in illegal activities, infringing on intellectual property rights, transmitting harmful or offensive content, or disrupting network integrity and security.
  • 3.2 You are responsible for obtaining and maintaining any equipment and ancillary services needed to connect to, access, or otherwise use the Services.

4. Payment Terms

  • 4.1 Fees for the Services will be billed as outlined in your service agreement.
  • 4.2 Late payments may result in service suspension or termination.

5. Privacy and Data Security

  • 5.1 Bluecall will maintain appropriate administrative, physical, and technical safeguards for the protection of the security, confidentiality, and integrity of your data.
  • 5.2 We will comply with applicable laws and regulations in relation to data privacy and security.

6. Service Availability and Limitations

  • 6.1 Bluecall aims to provide continuous service but does not guarantee uninterrupted or error-free operation.
  • 6.2 The Services may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

7. Termination

  • 7.1 Either party may terminate the Services with written notice as specified in your service agreement.
  • 7.2 Upon termination, your right to use the Services ceases immediately.

8. Limitation of Liability

  • 8.1 Bluecall shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or other intangible losses.

9. Governing Law

  • 9.1 This ToS shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.

10. General Provisions

  • 10.1 If any provision of this ToS is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the ToS will otherwise remain in full force and effect and enforceable.
